Any practice that results in a person being treated unfavourably on the grounds of pregnancy or a reason relating to childbirth, parenthood or family commitments constitutes discrimination on the basis of sex or gender. Employers cannot turn down people on the grounds of pregnancy, childbirth or parental leave in a recruitment situation or when allocating training placements. Employees must also not be dismissed or the continuation of their employment curbed on these grounds.
In practice, these provisions are especially important with regard to temporary employment contracts. For example, employers cannot turn down applicants for temporary employment on the grounds of pregnancy. Temporary employment contracts cannot be limited so as to expire at the beginning of a planned maternity, paternity or parental leave, and renewals of temporary employment contracts cannot be refused on the grounds of pregnancy or parental leave once work resumes. A substitution system can be used to provide parental leave cover for temporary employees as well.
