Discrimination in the workplace

Discrimination is prohibited in

  • recruiting new staff, appointing individuals to positions and allocating training placements,
  • remuneration and other terms and conditions of employment,
  • managing work, delegating tasks or otherwise arranging working conditions, and
  • terminating employment contracts and transferring or laying off employees.

Discrimination can be

  • direct discrimination,
  • indirect discrimination,
  • harassment, or
  • an order or instruction to engage in discrimination.

Any countermeasures taken by employers are also considered to constitute discrimination.

Who is protected under these provisions?

  • Anyone who has an employment contract in the private or public sector
  • People who work in some other kind of legal relationship comparable to employment (subject to limitations)
  • Enterprises that employ temporary labour (subject to limitations).
